Welcome to Habilitate Club. These Terms of Service govern your use of our website at habilitate.club and any related services, features, or content we provide. By accessing or placing an order through our website, you agree to be bound by these terms. If you do not agree, please do not use this site. We reserve the right to modify these terms at any time, and continued use after changes constitutes acceptance.

2. Who We Are

Habilitate Club is an independent online retailer based in Taunton, Somerset, United Kingdom. We design and sell custom print-on-demand apparel and collectibles celebrating British aviation heritage. We are not affiliated with any aircraft manufacturer, airline, or military organisation.

3. Eligibility

To use this website and place orders, you must be at least 18 years of age or have the consent of a parent or guardian. By placing an order, you confirm that you are legally capable of entering into binding contracts and that all information you provide is accurate and complete.

4. Our Products

All products are custom made to order using print-on-demand manufacturing. We do not hold stock. Product images are for illustrative purposes, and actual colours may vary slightly due to monitor settings and the print process. We describe our products as accurately as possible, but minor variations in print placement, texture, or colour are inherent to print-on-demand production and do not constitute defects unless they materially affect appearance or usability.

5. Pricing and Payment

All prices are displayed in GBP and include UK VAT where applicable. We reserve the right to change prices at any time without notice, but changes will not affect orders already placed. Payment is processed securely through Shopify Payments or third-party providers including PayPal, Apple Pay, and Shop Pay. We do not store your full payment details.

6. Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including but not limited to product unavailability, errors in pricing or description, or suspected fraudulent activity. Order acceptance occurs when we send you a dispatch confirmation email.

7. Shipping and Delivery

We offer standard and express shipping options as described on our Shipping Policy page. Delivery times are estimates and commence from the date of dispatch, not the date of order. Because products are custom made, please allow 5–10 working days for production before dispatch. We are not liable for delays caused by postal services, customs, or events outside our control.

8. Risk and Title

Risk of loss or damage passes to you upon delivery. Title remains with us until full payment has been received and the goods have been delivered to your specified address.

9. Right to Cancel and Returns

You have a statutory right to cancel your order within 14 days of receiving your goods. Returns must be initiated through your order on our website. Items must be unused, unworn, unwashed, and in original condition. Return costs are your responsibility unless the item is defective. Full details are in our Returns & Refund Policy.

10. Defective Goods

If an item arrives damaged, misprinted, or materially flawed, you must notify us within 30 days of delivery and initiate a return through your order on the website. We will offer a replacement, repair where feasible, or full refund including reasonable return postage costs. Minor print variations inherent to the process are not defects.

11. Intellectual Property

All content on this website, including designs, text, images, and code, is our property or used under licence. You may not reproduce, distribute, or exploit any content for commercial purposes without written permission. Our product designs are original works inspired by historical aircraft. Aircraft names and manufacturer marks are used descriptively and do not imply endorsement.

12. User Conduct

You agree not to use this website for unlawful purposes, to transmit harmful code, to interfere with its operation, or to submit false or misleading information. We may suspend or terminate access for violations.

13. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential, or punitive damages arising from your use of this website or purchase of our products. Our total liability shall not exceed the amount paid for the specific product giving rise to the claim. Nothing excludes liability for death, personal injury caused by negligence, fraud, or other liabilities that cannot be excluded under UK law.

14. Force Majeure

We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, fire, flood, pandemic, strikes, or failure of telecommunications or postal services.

15. Governing Law

These terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
